Welcome to Cosymor. These Terms & Conditions ("Terms") govern your access to and use of the website cosymor.com (the "Site") and the purchase of any products from Cosymor ("we", "us", "our"). By accessing the Site, creating an account, or placing an order, you agree to be bound by these Terms in full. If you do not agree, please do not use the Site.

1. Eligibility & Account

1.1. You must be at least 18 years of age and capable of entering into a legally binding contract under the Indian Contract Act, 1872 to purchase from this Site.

1.2. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us immediately of any unauthorised use.

1.3. We reserve the right to refuse service, suspend accounts, or cancel orders at our sole discretion, including where we detect fraudulent activity, abusive conduct toward our staff, policy abuse, or violation of these Terms.

2. Products, Pricing & Availability

2.1. All product images on the Site are for illustration. Actual colours and textures may vary slightly due to screen settings, photography, and natural variations in materials. Minor variations do not constitute a defect.

2.2. All prices are listed in Indian Rupees (INR) and are inclusive of GST unless stated otherwise. Prices, offers, and discounts may be changed or withdrawn at any time without notice. The price applicable to your order is the price displayed at the time of order confirmation.

2.3. Pricing errors: In the event a product is listed at an incorrect price or with incorrect information due to a typographical, technical, or system error, we reserve the right to cancel the order and issue a full refund of any amount paid, even after order confirmation or dispatch notification. We are under no obligation to honour an erroneous price.

2.4. Product availability is not guaranteed. If an item becomes unavailable after you place an order, we will cancel and refund that item in full.

2.5. Product specifications (dimensions, weight, foam density) may have a manufacturing tolerance of ±5%, which is normal and does not constitute a defect.

3. Orders & Acceptance

3.1. Your order is an offer to purchase. An order is accepted by us only when it is dispatched. An order confirmation email or payment receipt does not by itself constitute acceptance.

3.2. We reserve the right to cancel any order before dispatch, including for: suspected fraud, payment verification failure, incorrect or unserviceable delivery address, unusual order quantities suggesting resale, or pricing/listing errors. Any amounts paid will be refunded.

3.3. Cash on Delivery (COD): COD orders may require phone or WhatsApp verification before dispatch. Unverified COD orders may be cancelled. Customers with a history of refused COD deliveries may be required to prepay future orders.

3.4. Bulk, institutional, or resale purchases require prior written agreement. Products purchased on this Site are for personal use only; warranty and policies do not extend to resold products.

4. Shipping & Delivery

4.1. Estimated delivery timelines shown on the Site are indicative and not guaranteed. Delays caused by courier partners, weather, regional disruptions, or events beyond our reasonable control do not entitle you to compensation.

4.2. Risk in the products passes to you upon delivery to the address provided. You are responsible for providing an accurate, complete delivery address; we are not liable for orders delivered to an incorrectly supplied address.

4.3. If a delivery is refused or undeliverable due to customer unavailability, re-shipping charges may apply, or the order may be cancelled with shipping and COD handling costs deducted from any refund.

5. Returns, Exchange & Warranty

5.1. All returns, exchanges, refunds, and warranty claims are governed exclusively by our Returns, Exchange & Warranty Policy, which forms an integral part of these Terms. Please read it before purchasing.

5.2. Pillows, cushions, and support products are personal hygiene products. Used products are not eligible for return or refund except as expressly provided in the Returns, Exchange & Warranty Policy.

5.3. All claims are subject to the verification requirements stated in that policy (including continuous unboxing video, visible AWB and batch code). Claims that fail verification will not be processed.

6. Intellectual Property

6.1. All content on this Site — including the Cosymor name, logo, brand colours, product names, product designs, photographs, AI-assisted and original imagery, videos, text, product descriptions, graphics, page layouts, code, and the overall look and feel of the Site — is the exclusive property of Cosymor or its licensors and is protected under the Copyright Act, 1957, the Trade Marks Act, 1999, and other applicable laws.

6.2. You may not copy, reproduce, scrape, download, republish, distribute, modify, create derivative works from, or commercially exploit any Site content without our prior written consent. This includes use of our product photography or copy on marketplace listings, competitor sites, or social media ads.

6.3. Automated scraping, crawling, data mining, or bulk extraction of Site content, prices, or imagery — whether by bots, scripts, or AI training pipelines — is expressly prohibited.

6.4. "Cosymor" and associated marks may not be used in any domain name, social media handle, advertisement keyword, or business name in a manner likely to cause confusion.

6.5. We actively monitor for infringement and will pursue takedowns, marketplace complaints, and legal remedies against unauthorised use of our brand or content.

7. Acceptable Use of the Site

You agree not to:

  • Use the Site for any unlawful or fraudulent purpose, including placing orders with stolen payment instruments or false identities;
  • Submit false, fabricated, AI-generated, or manipulated evidence in support of any claim, review, or dispute;
  • Post or transmit content that is defamatory, obscene, infringing, or harmful;
  • Attempt to gain unauthorised access to the Site, its servers, other accounts, or any connected systems;
  • Interfere with the Site's operation, including through viruses, denial-of-service attacks, or load manipulation;
  • Misuse discount codes, referral programs, or promotional offers (including creating multiple accounts to claim offers).

Violation of this section may result in order cancellation, account termination, forfeiture of promotional benefits, and reporting to payment partners and law enforcement where applicable.

8. Reviews & User Content

8.1. By submitting reviews, photos, videos, or testimonials to the Site or tagging Cosymor on social media, you grant Cosymor a perpetual, royalty-free, worldwide licence to use, reproduce, and display that content for marketing and promotional purposes, with or without attribution.

8.2. Reviews must be genuine and based on actual product use. We reserve the right to remove reviews that are fake, incentivised by competitors, abusive, irrelevant, or in violation of law. Posting knowingly false reviews about our products may attract liability under applicable law.

9. Disclaimers

9.1. Cosymor products are comfort and support products. They are not medical devices and are not intended to diagnose, treat, cure, or prevent any medical condition, including cervical spondylosis, back pain disorders, or sleep disorders. Any references to support, alignment, or relief describe general comfort benefits only. Consult a qualified medical professional for medical concerns.

9.2. Results and comfort experiences vary from person to person. Adaptation to memory foam products may take several days and is normal.

9.3. The Site and its content are provided on an "as is" and "as available" basis. While we strive for accuracy, we do not warrant that the Site will be uninterrupted, error-free, or free of harmful components.

10. Limitation of Liability

10.1. To the maximum extent permitted by applicable law, Cosymor's total aggregate liability arising out of or in connection with any order, product, or use of the Site shall not exceed the amount actually paid by you for the specific product giving rise to the claim.

10.2. We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill, even if advised of the possibility of such damages.

10.3. Nothing in these Terms limits or excludes liability that cannot be limited or excluded under Indian law, including your statutory rights under the Consumer Protection Act, 2019.

11. Indemnity

You agree to indemnify and hold harmless Cosymor, its proprietors, employees, and partners from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your breach of these Terms, your misuse of the Site, your violation of any law or third-party rights, or any false or fraudulent claim submitted by you.

12. Force Majeure

We shall not be liable for any failure or delay in performance caused by events beyond our reasonable control, including natural disasters, epidemics, strikes, courier or logistics failures, governmental actions, internet or payment infrastructure outages, or supply chain disruptions.

13. Privacy

Your use of the Site is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information in accordance with applicable Indian data protection law, including the Digital Personal Data Protection Act, 2023.

14. Modifications to Terms

We may update these Terms at any time. The version published on the Site at the time you place an order governs that order. Continued use of the Site after changes are posted constitutes acceptance of the revised Terms.

15. Governing Law & Dispute Resolution

15.1. These Terms are governed by and construed in accordance with the laws of India.

15.2. Subject to applicable consumer protection law, courts at Jaipur, Rajasthan shall have exclusive jurisdiction over any disputes arising from these Terms or your use of the Site.

15.3. Before initiating any formal proceedings, you agree to first contact us at contact@cosymor.com and allow 30 days for good-faith resolution. Most issues are resolved well within this period.

15.4. Nothing in this section prevents you from approaching the appropriate Consumer Disputes Redressal Commission as provided under the Consumer Protection Act, 2019.

16. Severability & Entire Agreement

If any provision of these Terms is held invalid or unenforceable, the remaining provisions shall continue in full force. These Terms, together with the Returns, Exchange & Warranty Policy, Privacy Policy, and Shipping Policy, constitute the entire agreement between you and Cosymor regarding the Site and your purchases.
